Fill in before publishing: the effective date, and the governing country/courts in section 10. This is a draft; have a lawyer review the liability and governing-law clauses in particular.

1. Who these terms are between

GTM is made by NAMIRA SYSTEM. This document is the agreement between you — the person opening the app on their phone — and NAMIRA SYSTEM, about the software itself.

One thing has to be clear from the start, because most questions come back to it: your working relationship is with your employer, not with us. Your employer created your account, owns the server, and decides what is asked of you — route recording, attendance selfies, forms. We build the software and license it to organisations; we play no part in how your employer chooses to use it.

2. Who may use it

3. Your account, and looking after it

4. Acceptable use

While using the app, do not:

5. The content you enter

Photos, messages, forms and everything else you record in the app are your organisation’s work data, held on its server. Ownership and responsibility for it sit with the organisation and with you, not with NAMIRA SYSTEM. We do not become the owner of that content and do not use it for any other purpose.

For what is collected and where it goes, read the privacy policy. It forms part of these terms.

6. Location recording

Because it is the most sensitive part of the app, it is repeated here: location is recorded only between “Start Work” and “End Work”, continues in the background within that window, and keeps a persistent notification on your screen for as long as it is on. Before the first permission request, the app explains this and asks you to accept it. You may refuse, or withdraw the permission later in your phone’s settings; route recording then stops and the rest of the app keeps working — but whether your employer requires it is between you and them.

7. Intellectual property

The app itself, the names and marks “GTM” and “NAMIRA SYSTEM”, and its design and code belong to NAMIRA SYSTEM. What you are granted is permission to use the app for work — not to copy, sell, rent, modify or reverse-engineer it.

8. Availability

9. Limits of liability

The app is provided “as is”. We work to make it correct, but we do not guarantee it will be faultless or uninterrupted. NAMIRA SYSTEM is not liable for indirect losses — lost profit, opportunity or data — except so far as the law does not allow such liability to be limited. Nothing here excludes liability that the law says cannot be excluded.

10. Governing law

These terms are governed by the law of [country], and disputes fall to the competent courts there, unless the law of your own country of residence requires otherwise.

11. Ending access

Your access is granted and withdrawn by your organisation; when your employment ends, that organisation closes your account. We may restrict an account that plainly breaches these terms, and will tell the organisation concerned if we do.

12. Changes to these terms

If this text changes, the date at the top is updated and the new version is published at this same address. Continuing to use the app afterwards means accepting the new version.
